Acceptable Use Policy

1. Scope
This Acceptable Use Policy ("AUP") governs how you may use Scalry, operated by Scalry Inc. It forms part of, and is incorporated by reference into, our Terms & Conditions. Where this AUP and the Terms conflict on a question of permitted use, this AUP controls.
It applies to every user of the platform, to everyone you grant access to your workspace, and to every message sent through the platform — email, LinkedIn, SMS, or voice.
2. What Scalry is, and who the sender is
Scalry is a business-to-business sales engagement platform. Our customers use it to manage their own CRM records, sequence their own outreach, and hold conversations with people they have chosen to contact.
We do not send messages on our own behalf, and we do not decide who you contact. You are the sender of record for every message you originate through Scalry. You are responsible for the lawful basis, the content, the sender identity, and the consequences.
We are not a data broker. Scalry does not sell, rent, or supply contact lists. Where the platform enriches a record through a third-party data provider, you remain responsible for confirming that you have a lawful basis to contact that person.
3. Before you send anything
You must be able to satisfy all of the following, for every recipient, before a message leaves the platform:
- A lawful basis to contact them. Consent where the law requires consent; a documented legitimate-interest assessment where that is the basis you rely on. You must be able to produce it on request.
- An accurate sender identity. Real sender name, a real reply-to address that reaches you, and headers that are not forged, disguised, or misleading.
- A subject line that reflects the message. No deceptive, baiting, or false-context subject lines, and no fabricated "Re:" or "Fwd:" threading.
- Your own valid physical postal address in commercial email, as CAN-SPAM and equivalent laws require.
- A working, honoured opt-out. Every commercial email must carry a functioning unsubscribe. Opt-outs must be processed promptly and must persist — across campaigns, across lists, and across re-imports.
- Relevance to the recipient's job. Scalry is for business-to-business outreach. Marketing to consumers at personal addresses is outside what this platform is for, and in many jurisdictions requires prior consent that cold outreach does not have.
4. Prohibited practices
You may not use Scalry to do any of the following. This list is illustrative, not exhaustive.
- Send unsolicited bulk messages to recipients you have no lawful basis to contact.
- Upload purchased, rented, harvested, or scraped lists where no valid consent or legitimate-interest basis exists.
- Ignore, delay, or work around an opt-out, or re-add a contact who has opted out.
- Forge headers, spoof domains, impersonate another person, company, or brand, or misrepresent your affiliation.
- Send phishing, credential harvesting, malware, or any other deceptive or fraudulent message.
- Deliberately mail spam traps, or continue sending to addresses that hard-bounce.
- Spread volume across many domains, mailboxes, or accounts to evade spam filtering, rate limits, or reputation monitoring ("snowshoeing").
- Evade, disable, or tamper with the platform's own sending limits, suppression lists, approval gates, or do-not-call controls.
- Share, resell, or provide access to sending infrastructure provisioned through Scalry to a third party.
- Harass, threaten, defame, or repeatedly contact someone who has asked you to stop.
5. Prohibited content and sectors
You may not use Scalry to promote:
- Adult content or services.
- Gambling, betting, or lotteries where not licensed for the recipient's jurisdiction.
- Illegal drugs, controlled substances, or prescription pharmaceuticals sold without a prescription.
- Weapons, ammunition, or explosives.
- Multi-level marketing, pyramid or matrix schemes, "get rich quick" offers, or work-from-home income claims.
- Payday lending, debt relief, credit repair, or advance-fee lending.
- Cryptocurrency token promotions, coordinated buying campaigns, or unregistered investment offers.
- Counterfeit goods, pirated media, or stolen credentials and data.
- Hate speech, incitement to violence, or content targeting people on the basis of a protected characteristic.
- Health, medical, or financial claims that are false, unproven, or misleading.
6. LinkedIn and other connected platforms
When you connect a LinkedIn account or any other third-party platform to Scalry, you authorise us to act on that account at your direction. That does not transfer responsibility for it.
- You must comply with that platform's own user agreement, automation policy, and rate limits. Those terms are between you and that platform, and they may be stricter than this AUP.
- You may only connect an account you personally control and are authorised to automate. Do not connect an account belonging to someone else, and do not share credentials.
- You must respect the platform's connection, messaging, and viewing limits. Scalry applies its own pacing, but the limits that matter are the platform's.
- We cannot and do not guarantee that automation will avoid restriction, suspension, or permanent loss of your third-party account. That risk is yours, and we are not liable for what a platform decides to do about your account.
7. How we monitor and enforce this
We monitor bounce rates, complaint rates, spam-trap hits, blacklist listings, and abuse reports from recipients and from our upstream infrastructure and platform providers.
The platform also enforces controls that you cannot switch off: suppression of unsubscribed contacts, a do-not-call list applied before any voice campaign dials, per-mailbox sending caps, and an approval queue for AI-drafted actions where a workspace has enabled it.
Where we find a breach, or where an upstream provider requires it, we may — without prior notice, and before completing our own investigation —
- throttle or pause your sending;
- suspend or disconnect a mailbox, domain, or connected third-party account;
- suspend or terminate your workspace; and
- retain, and where legally required disclose, records relating to the activity.
For domains and mailboxes provisioned through Scalry, we or our infrastructure partners remain the registrant or account holder of record. You hold a limited right to use them for lawful outreach; you do not acquire ownership, and we may reclaim them on breach.
Termination for breach of this AUP does not entitle you to a refund of fees already paid.
8. Reporting abuse
If you have received a message you believe was sent through Scalry in breach of this policy, report it to our contact page. Include the full message headers where you can — they let us identify the sending workspace.
We investigate every report. Recipients do not need a Scalry account to report abuse, and we will not disclose your report to the sender except where the law requires it.
9. Data protection
For personal data you upload or collect about your own contacts, you are the data controller and we act as your processor, on your instructions. You are responsible for your own privacy notice, for your lawful basis, and for answering the access, correction, and deletion requests your contacts make to you.
For personal data we hold about you as our customer, we are the controller. Our Privacy Policy covers that.
10. Changes to this policy
We may update this AUP as the law, our infrastructure providers' requirements, or the platform changes. Material changes will be notified before they take effect. Continuing to use Scalry after that means you accept the revised policy.
